CUSTOM AND HANDMADE PRODUCTS

Many JAX Secret Kustomz products are:

  • Made-to-order
  • Handmade
  • Printed
  • Pressed
  • Sewn
  • Assembled
  • 3D printed

Minor differences between products may occur and are a normal part of customized or handmade production.

3D-PRINTED PRODUCTS

3D-printed products may contain normal characteristics of additive manufacturing, including:

  • Layer lines
  • Small surface variations
  • Minor texture differences
  • Slight color variations between filament batches
  • Minor differences between individual prints

These normal characteristics do not automatically constitute a defect.

SECTION 3 — ORDERS

When you submit an order, you are making an offer to purchase products or services from JAX Secret Kustomz.

We reserve the right to accept or decline any order or custom-order request at our discretion, subject to applicable law.

An inquiry, quote request, custom-order form submission, discussion, or invoice does not by itself confirm an order or reserve a production date.

PAYMENT

PAYMENT IS DUE IN FULL BEFORE ANY DESIGN WORK, CUSTOMIZATION, PRODUCTION, OR OTHER WORK BEGINS.

An order is not confirmed and a production date is not secured until:

  1. The order has been accepted by JAX Secret Kustomz;
  2. All required order information has been provided; and
  3. Full payment has been received.

Customers are responsible for reviewing all order details carefully before submitting payment.

This includes:

  • Names
  • Spelling
  • Dates
  • Colors
  • Sizes
  • Quantities
  • Wording
  • Personalization
  • Product selections
  • Shipping information
  • Other custom details

If we make a change to or decline an order, we may contact you using the email address, telephone number, billing information, or other contact information provided with the order.

SECTION 4 — CUSTOM ORDERS

Submitting a custom-order request does not guarantee that your request will be accepted.

Custom-order requests are subject to:

  • Product availability
  • Material availability
  • Current workload
  • Requested completion date
  • Design complexity
  • Quantity
  • Production capability
  • Other relevant factors

PROOFS AND APPROVALS

When a proof or mockup is provided, the customer is responsible for reviewing all details carefully before approval.

Once a proof is approved, JAX Secret Kustomz is not responsible for customer-approved errors, including errors involving:

  • Spelling
  • Dates
  • Names
  • Colors
  • Placement
  • Quantities
  • Sizing
  • Other approved customization details

CHANGES AFTER PAYMENT

Changes requested after payment are not guaranteed.

If work has already begun, requested changes may:

  • Be unavailable;
  • Delay completion; or
  • Require an additional fee.

SECTION 5 — ALL SALES ARE FINAL

ALL SALES ARE FINAL.

Except where required by applicable law, payments are non-refundable, and completed purchases cannot be canceled, returned, refunded, or exchanged after payment has been submitted.

This policy is especially applicable to:

  • Personalized items
  • Custom-made products
  • Made-to-order products
  • Digital products
  • Custom apparel
  • Custom drinkware
  • Custom 3D prints
  • Event-specific products
  • Products created specifically for an individual customer

Please review your order carefully before submitting payment.

Nothing in these Terms limits any rights or remedies that cannot legally be waived under applicable consumer-protection law.

If JAX Secret Kustomz makes an error or a product arrives with a qualifying defect or shipping damage, please contact us so the issue can be reviewed.

SECTION 6 — PRICES AND BILLING

Prices, discounts, and promotions may change without notice.

The price charged will generally be the price displayed at the time your order is placed or otherwise confirmed for a custom order.

Unless otherwise stated, listed prices may not include:

  • Taxes
  • Shipping
  • Handling
  • Customs charges
  • Duties
  • Import fees
  • Other applicable charges

Promotional offers may be subject to additional terms.

If promotional terms conflict with these Terms, the specific promotion terms will govern with respect to that promotion.

You agree to provide current, complete, and accurate billing, payment, and account information.

You represent and warrant that:

  • Payment information provided is accurate;
  • You are authorized to use the payment method;
  • Charges will be honored by your payment provider; and
  • You will pay all applicable charges associated with your purchase.

SECTION 7 — SHIPPING AND DELIVERY

Processing time and shipping time are separate.

Processing time refers to the time needed to create, prepare, customize, package, or otherwise complete an order.

Shipping time begins after the completed package has been transferred to the shipping carrier.

All delivery estimates are estimates only unless expressly guaranteed by the carrier.

JAX Secret Kustomz is not responsible for delays caused by:

  • Shipping carriers
  • Weather
  • Transportation disruptions
  • Customs
  • Holiday volume
  • Incorrect addresses
  • Events outside of our reasonable control

Customers are responsible for providing a complete and accurate delivery address.

SECTION 8 — DIGITAL PRODUCTS

JAX Secret Kustomz may offer digital products including, but not limited to:

  • STL files
  • 3MF files
  • SVG files
  • PNG files
  • DXF files
  • PDF files
  • Templates
  • Printable designs
  • Other downloadable files

Unless otherwise stated, digital products are delivered electronically and no physical item will be shipped.

DIGITAL SALES

Digital sales are final and non-refundable once access to the file has been provided, except where required by law.

Customers are responsible for determining whether the purchased file is compatible with their:

  • Equipment
  • Printer
  • Cutting machine
  • Software
  • Slicer
  • Device
  • Intended use

DIGITAL FILE LICENSE

Unless otherwise stated in the individual product listing, purchasing a digital file grants the buyer permission to use the file for personal projects and to create finished physical products.

Purchasing a digital file does not transfer ownership or copyright of the digital design.

Customers may not:

  • Resell the digital file;
  • Share the digital file;
  • Give the digital file away;
  • Upload it to groups, shared drives, websites, or file-sharing services;
  • Redistribute the file;
  • Include the file in another digital bundle;
  • Claim the design as their own;
  • Sell or redistribute modified versions of the digital file; or
  • Provide the original digital file to customers or third parties.

SECTION 9 — INTELLECTUAL PROPERTY

The Services and their contents, including but not limited to:

  • Brand names
  • Logos
  • Text
  • Product descriptions
  • Graphics
  • Photography
  • Videos
  • Digital designs
  • Digital files
  • Product designs
  • Website design
  • Reviews
  • Audio
  • Other content

may be owned by JAX Secret Kustomz, Shopify, licensors, or other respective rights holders and may be protected by copyright, trademark, patent, and other intellectual property laws.

These Terms permit use of the Services for lawful personal use only unless otherwise expressly authorized.

You may not reproduce, distribute, modify, republish, sell, store, transmit, or commercially exploit protected material without the appropriate authorization.

Nothing in these Terms grants ownership of any intellectual property belonging to JAX Secret Kustomz, Shopify, or another rights holder.

All rights not expressly granted are reserved.

SECTION 10 — OPTIONAL TOOLS

We may provide access to tools or services offered by third parties.

We may not monitor or control such third-party tools.

Access may be provided “as is” and “as available,” subject to applicable law.

New tools, resources, and features added to the Services may also be subject to these Terms.

JAX Secret Kustomz is not responsible for the content, privacy practices, security, accuracy, products, or services of independent third parties.

SECTION 12 — RELATIONSHIP WITH SHOPIFY

JAX Secret Kustomz is powered by Shopify, which enables us to provide the Services to you.

However, sales and purchases made through our store are transactions directly between you and JAX Secret Kustomz.

By using the Services, you acknowledge that Shopify is not the seller of products offered by JAX Secret Kustomz and is not responsible for the fulfillment or performance of transactions between you and JAX Secret Kustomz, except to the extent otherwise required by applicable law or applicable Shopify services.

Personal information collected through the Services is subject to our Privacy Policy.

  • Every product will meet subjective expectations;
  • Every device or software program will be compatible with digital files;
  • Every 3D printer will produce identical results from the same digital file.

Nothing in this section excludes rights or warranties that cannot legally be excluded under applicable consumer law.

SECTION 20 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, JAX Secret Kustomz and its applicable partners, employees, contractors, agents, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the Services or products.

This may include, where legally permitted:

  • Lost profits
  • Lost revenue
  • Lost savings
  • Loss of data
  • Replacement costs
  • Other similar losses

These limitations apply only to the fullest extent permitted by applicable law.

Nothing in these Terms limits liability where such limitation is prohibited by law.
